KHRC Imposes $1,000 Per Day Fine On Churchill's Derby City Gaming

The Kentucky Horse Racing Commission has fined Churchill Downs, Inc. for violations with the 900 Ainsworth Game Technology historical racing machines at its Derby City Gaming location, according to courierjournal.com. The fines, accumulating at a rate of $1,000 per day, are related to a regulation that races with scratched horses cannot be used to determine outcomes in historical wagering.
The violations were originally noted on Oct. 24, and KHRC executive director Marc Guilfoil wrote a letter to Churchill Downs president Kevin Flanery instituting the daily fines on Sept. 10.
Churchill Downs released the following statement regarding the issue:

"We are working diligently with the Kentucky Horse Racing Commission (KHRC) to address the technical violation of allowing wagers on historical races from which runners were scratched after entries were taken.
"Importantly, however, the historical racing machines in use at Derby City Gaming have never enabled any wagers on a horse that did not run in a race. If a horse was scratched at any time prior to a race, that horse was removed from the field and was not eligible for wagering.
"As the KHRC letter acknowledges, no patrons were harmed because they were only given the option to wager on horses that ran in the race. We are working collaboratively with the KHRC and our development partner to correct this technical matter. Derby City Gaming will continue operating as normal."
